All visitors will be referred to as “User”, “You” or “Your”. 

As a User, You will be bound by these Terms of Use. 

The terms “We”, “Us” and “Our” refer to Be Treated.

“Content” means any text, graphics, audio and video and any social media channels we operate (@betreatedbymaddy) and any emails We send to You.

This Site is intended for use by people over 18 years of age. 

This Site is directed at people residing in the United Kingdom. The content of this Site may not be available or appropriate in other locations. This Site is written in English and We do not take responsibility for any translations that might be applied to this Site.

This Site is available free of charge.

We don’t guarantee the availability of the Site or any Content on it.  We may suspend, withdraw or restrict the availability of all or any of Our Site for any reason but We’ll try to give You reasonable notice if We do so.

If anyone accesses our Site through Your internet connection, it’s Your responsibility to make them aware of these Terms of Use and to make sure they comply with them.

We don’t guarantee that this Site will be secure or free from bugs or viruses.

You’re not permitted to directly reprint or republish the Site content in full or in part.  If You print, copy or download any part of our Site, Your right to use our Site will cease immediately and You must either return or destroy any copies of the material that You have made.

Where it is unlawful for Us to do so, We don’t exclude or limit Our liability to You. We do not exclude or limit liability for death or personal injury caused by Our negligence or by the negligence of Our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms that may apply to Our Site or any Content on it.

We will not be liable to You for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if it was foreseeable, arising under or in connection with the use of or the inability to use Our Site, or the use or reliance on any Content displayed on Our Site. 

We will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation or any indirect or consequential loss or damage.

If defective digital content that We have supplied damages a device or digital content belonging to You and this is caused by Our failure to use reasonable care and skill, We will either repair the damage or pay You compensation.

If You have purchased a product or service from Us, Our liability to You in respect of that product or service will be set out in the terms relating to that purchase.

To the maximum extent permissible at law, our aggregate liability to You in connection with these terms howsoever arising in contract, negligence or otherwise is limited to £6m.

In the event of any dispute, We ask that You contact Us in the first instance so We can work together, in good faith, to resolve the dispute.  Where it is not possible to resolve the dispute to Our mutual satisfaction, You agree that the dispute shall be referred to meditation.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE BOOKING AN APPOINTMENT ONLINE VIA OUR THIRD PARTY BOOKING PLATFORM, FRESHA.

THIS SECTION COVERS OUR BOOKING PROCESS, CANCELLATION POLICY, LATE ARRIVALS & NO SHOWS, PREGNANCY & POSTNATAL POLICIES, HEALTH CONDITIONS INCLUDING CONTRAINDICATIONS AND LASTLY, OUR AGE POLICY.

1. BOOKING PROCESS

All bookings are managed online through via our third party booking platform, Fresha. New clients are required to make their first booking online. Thereafter, future bookings can be made in person, online, or simply by contacting us via email or WhatsApp. Please note, appointments cannot be secured via Instagram direct messages.

If you don’t already have a Fresha account, you will need to create one by using either your Facebook or Google account, or by simply using your email address.

The following information is required at the time of creating a Fresha account:

  • Email

  • First and last name

  • Mobile number

  • Create a password

  • Agree to Fresha’s Privacy Policy, Terms of Use and Terms of Service

  • It is optional to receive Fresha’s marketing notifications complete with offers and news

By booking an appointment online, you are agreeing to the cancellation policy and terms and conditions Be Treated have set out above and below.

All new clients are required to fill out a pre-treatment consultation form prior to their first visit. The form is sent via email and can be completed online. Clients are not required to fill out any further forms, unless pregnant or should any circumstances change such as health conditions and personal contact information. See here for further information regarding our privacy policy.

Be Treated does not take payment until the day of the booked appointment, unless doing so in line with the cancellation policy set out below. 

When making payment on the day, we accept payment via cash or our SumUp card machine. We accept all major debit and credit cards, including AMEX.

2. CANCELLATION POLICY

Cancel for free up to 48 hours ahead, otherwise you will be charged 50% of the service price for late cancellation or 100% for not showing up.

Failure to comply with our policies will result in no future booking with Be Treated until payment is made. We ask that you respect our cancellation policy as a small business and only book an appointment if you are happy with these terms. 

3. LATE ARRIVALS AND NO-SHOWS

We advise you to arrive in good time for your treatment. Arrivals later than 15 minutes from the time of your scheduled appointment without communication will be treated as a no-show and full payment will be due.

If you arrive late to your appointment for any reason, your treatment time will be reduced in consideration of the next client.

4. PREGNANCY & POSTNATAL

Be Treated offers prenatal treatments to those in their second or third trimester (13+weeks) and postnatal treatments to those when they feel ready, following a healthy pregnancy and delivery. It is recommended that you consult your doctor or healthcare professional before booking your first Prenatal or Postnatal Massage.

Be Treated must be informed of any pregnancies to the best of the clients knowledge at the time of booking. Please ensure you have booked a Pregnancy and Postnatal Massage via Fresha.

We ask that you complete your consultation forms as early as possible. Any client who arrives at an appointment under circumstances that we cannot treat will not receive the booked service and full payment will be required. Likewise, if information comes to light within the 48 hour cancellation period, Be Treated reserves the right to enforce the 50% fee.

Be Treated will not be held liable for any consequences in connection with a client not disclosing pregnancy to us prior to the booked appointment.

5. HEALTH CONDITIONS

Be Treated must be informed of any health conditions to the best of your knowledge at the time of booking.

Regrettably, Be Treated is not insured to work with cancer patients, nor do we hold the expertise in Oncology massage to ensure that clients receive a safe treatment under these circumstances. We would be happy to recommend a local specialised practitioner should this be appropriate.

Be Treated kindly asks that you complete your consultation form as early as possible prior to your treatment. All health conditions and any current medication must be disclosed on your form. If you arrive to your appointment under circumstances that we can’t treat, you will not receive the booked service and full payment will be required.

Likewise, if information comes to light within the 48 hour cancellation period, Be Treated reserves the right to enforce the 50% fee.

CONTRAINDICATIONS

There will be times where it might not be safe to undergo massage therapy.  In the interests of your well-being, if you have any of the following conditions, we do not recommend receiving treatment:

  • Deep Vein Thrombosis (present in the last 6 months)

  • Bleeding disorders such as Haemophilia (a disorder in which the blood does not clot due to insufficient clotting factors)

  • Fever / flu / colds and other contagious diseases

  • Hypertension (where blood pressure is too high) or Hypotension (where blood pressure is too low) or other heart conditions

  • Prescription drugs, recreational drugs and alcohol until totally cleared from bodily systems

  • Pregnancy in the first trimester (<13 weeks)

  • Bronchitis to prevent more inflammation and the spread of infection

  • Kidney infections to prevent the spread of infection

  • Recent injuries or major surgeries

  • Bacterial / fungal infections (athlete's foot / fungal nail infection / verucca)

  • Nervous system disorder

Some conditions require you to have written medical consent from your doctor in order to receive a treatment such as severe osteoarthritis / rheumatoid arthritis. Please don't hesitate to contact us if you have any questions about your eligibility to receive massage therapy at Be Treated. The list above provides some common examples and is not an exhaustive list.

6. AGE POLICY

Please note a minimum age of 18 is required to receive a treatment at Be Treated. Regrettably, Be Treated will not treat clients under the age of 18 even if written consent is given by a parent or guardian.

Testimonial Consent & Release

From time to time, Be Treated (“We”, “Us”, “Our”) collect testimonials that We may use to promote Our business.

By providing a testimonial to Us, you agree that We can use your name, your company name and your country location along with your testimonial and any image(s) of you that you provide to Us.

We may reasonably edit your testimonial, but We will only ever use your testimonial in the context of the products and/or services We provided to you.  You waive the right to review or approve the finished product ahead of Us publishing your testimonial.

We’ll only use this testimonial for promotional purposes on Our website www.betreated.co.uk, on Our social media channels @betreatedbymaddy and various other print or electronic advertising and information material that We may determine.  Our use of your testimonial will always be in accordance with Our Privacy Policy and any applicable laws.

You agree that all intellectual property rights vesting in the testimonial (excluding any image(s) that you may provide to Us) are assigned to Us and that We may use the testimonial in accordance with this release. 

You further agree that We won’t pay any amounts or provide you with other compensation for the testimonial.

If at any time you no longer want Us to use your testimonial, please email us at info@betreated.co.uk.

By providing a testimonial, you are agreeing to be bound by the terms of this Testimonial Consent and Release.
